Points used on this Platform are part of the Monetha ecosystem loyalty rewards program. Points are earned through cashback from shopping activities outside this Platform, not through monetary purchases or deposits by users.

By using the Platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding contracts
• You are not prohibited by law from accessing or using the Platform
• You will maintain only one account per person
• All information you provide is accurate and truthful

4.1 Nature of Points: Points used on Monetha Versus are part of the Monetha ecosystem loyalty rewards program. These points are:

• Earned as cashback from legitimate shopping activities in the Monetha ecosystem
• Provided to users at NO COST - users never purchase or deposit money to obtain points
• Part of a rewards program, similar to airline miles or credit card points
• Redeemable for rewards within the Monetha ecosystem as specified in the Monetha platform terms

4.2 No Money Required: Users NEVER need to pay money, make deposits, or purchase points to use this Platform. Points used here are exclusively:

• Earned through cashback from shopping outside this Platform
• Provided as sign-up bonuses and promotional rewards
• Awarded for platform participation and activities

Because points originate from cashback rewards (not user payments), activities on this Platform do NOT constitute gambling, betting, or wagering with user funds.

4.3 Point Sources on Versus Platform: Within Monetha Versus, you can gain or lose points through:

• Initial sign-up bonuses
• Voting on questions (points redistributed based on majority outcome)
• Creating popular questions (earning commission from vote activity)
• Promotional campaigns or events

4.4 Point Redistribution Model: When users vote on questions, points are pooled and redistributed to users who voted with the majority opinion. This is a zero-sum social game where:

• No house takes a cut (except small creator commission)
• Outcomes are based on collective human opinion, not random chance
• All points involved came from cashback, never from user deposits

4.5 Point Redemption: Points can be redeemed for rewards through the Monetha ecosystem as outlined in the main Monetha platform terms and conditions. Redemption is governed by Monetha's rewards program, not by Monetha Versus.

4.6 Point Modification: We reserve the right to modify, adjust, or remove points from user accounts at our sole discretion, including but not limited to cases of:

• Violation of these Terms
• Fraudulent activity or abuse
• Technical errors or bugs
• Platform maintenance or updates

4.7 No Liability for Point Loss: We are not liable for any loss of points for any reason, including technical failures, account termination, or platform shutdown.

You agree NOT to:

• Create multiple accounts or use automated systems (bots)
• Manipulate votes or outcomes through fraudulent means
• Post illegal, harmful, threatening, abusive, or offensive content
• Violate intellectual property rights
• Attempt to hack, compromise, or disrupt the Platform
• Harass, bully, or intimidate other users
• Post spam, advertisements, or unsolicited promotions
• Impersonate others or provide false information
• Attempt to buy, sell, or trade points or accounts
• Use the Platform for any illegal purpose

7.1 User Opinions Only: All content on the Platform, including questions, answers, votes, and comments, represents the personal opinions and views of individual users, NOT the views of Monetha Versus or its operators.

We are NOT responsible for user opinions, statements, or predictions made on the Platform. Users express their own views at their own discretion.

7.2 Your Responsibility: You are solely and exclusively responsible for all content you create, post, or share on the Platform, including:

• Questions and answer options you create
• Votes and predictions you make
• Comments and discussions you participate in
• Any claims, statements, or opinions you express

7.3 Freedom of Expression: We believe in freedom of speech and open discourse. Users are generally free to express opinions, create questions on various topics, and engage in debates, subject to the limitations in section 6 (prohibited activities).

7.4 Content Moderation: While we support freedom of expression, we:

• Make reasonable efforts to moderate content and remove clearly illegal, violent, or abusive material
• Reserve the right to remove, edit, or refuse to display any content at our sole discretion, without notice or explanation
• Will remove content upon valid legal requests from authorities or copyright holders
• May take down content based on user reports or complaints
• Are NOT obligated to monitor, review, or moderate all content proactively

IMPORTANT: We do our best to moderate harmful content, but we cannot guarantee that all content complies with all laws or community standards. We are not liable for user-generated content that appears on the Platform.

• Endorse any user opinions, statements, or predictions
• Verify the accuracy or truthfulness of user content
• Guarantee the quality or appropriateness of content
• Take responsibility for the consequences of user opinions or predictions

7.8 Third-Party Rights: You represent that your content does not violate any third-party rights, including intellectual property, privacy, or publicity rights. You will indemnify us for any claims arising from your content.

8.5 Maximum Liability: Our total liability to you for any claims arising from these Terms or use of the Platform shall not exceed $0 (zero dollars), reflecting that the Platform is a free entertainment service with no monetary transactions.

You agree to indemnify, defend, and hold harmless Monetha Versus, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your content posted on the Platform

10.1 By Us: We reserve the right to suspend or terminate your account at any time, for any reason or no reason, without notice or liability.

10.2 By You: You may delete your account at any time. Upon deletion, you forfeit all virtual points and content associated with your account.

10.3 Effect of Termination: Upon termination, your right to use the Platform ceases immediately. All provisions that should survive termination shall survive, including disclaimers and limitations of liability.

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to our collection and use of personal data as described in the Privacy Policy.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

We reserve the right to:

• Modify, suspend, or discontinue any feature or the entire Platform
• Change how points are earned, distributed, or used
• Remove or modify any content or functionality

We shall not be liable to you or any third party for any such modifications, suspensions, or discontinuations.

14.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

14.2 Dispute Resolution: Any disputes arising from these Terms or use of the Platform shall first be attempted to be resolved amicably through good faith negotiations.

14.3 Arbitration: If disputes cannot be resolved amicably, they shall be submitted to arbitration in Zug, Switzerland, in accordance with Swiss arbitration rules.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and Monetha Versus regarding the use of the Platform and supersede all prior agreements and understandings.
